The Sheriff's Office has a statutory responsibility to serve civil process papers and execute orders. To accomplish this, Menominee County Sheriff's Deputies attempt to serve civil papers in between emergency and complaint calls. Paper service is attempted during both daytime and evening hours, on weekdays and weekends. 

Successful service on a defendant is dependent upon the accuracy of information that we receive from the plaintiff or attorney, as well as the willingness of the individual to accept service. Any additional information you can provide about the individual being served, including current phone numbers, employment information, or vehicle information, may help expedite service. Deputies will make multiple attempts to contact and serve an individual before papers are returned unsuccessful.

Individuals who wish to have someone served should provide two copies of the civil documents to the Sheriff's Office. Service fees are collected in advance, and are based on the type of document and mileage to the defendant's address. After service attempts are completed, a copy of the documents are returned to the plaintiff (or plaintiff's attorney), indicating whether service was successful. The Sheriff's Office will NOT forward a Proof of Service to the court - it is up to the plaintiff (or attorney) to provide this paperwork to the appropriate court.

PERSONAL PROTECTION ORDERS & RESTRAINING ORDERS
The Sheriff's Office provides service of Personal Protection Orders (PPOs) to individuals residing in Menominee County. If the defendant lives outside of Menominee County, you will need to contact the Sheriff's Office where they reside to arrange for service. 

The Sheriff's Office asks for prepayment of service fees for PPOs. Protection Orders originating from a Michigan court are charged a flat fee of $40.00 - no mileage charges are incurred. Protection orders from out-of-state court systems have a $50.00 service fee, which includes fees for notarization of returned documents. 

FORECLOSURE SALES
Foreclosure sales, or "Sheriff sales", are open auction sales conducted on Fridays at 10:30 AM and are held on an as-needed basis. Sales occur outside the Menominee County Clerk's Office, located on the 2nd floor of the Menominee County Courthouse at 839 10th Avenue, Menominee, MI 49858.

The Sheriff's Office does not maintain a list of properties going through the foreclosure process, nor do we have any information about specific properties that are pending sale. Properties going through the foreclosure and sale process are typically advertised in local newspapers; foreclosure notices are also posted in the Courthouse, outside of the County Clerk/Circuit Court office.
