In Michigan, a victim is an individual who suffers direct or threatened physical, financial, or emotional harm as a result of the commission of a crime (PDF).

The Michigan Crime Victim’s Right Act provides crime victims with basic rights and protections. The Menominee County Prosecuting Attorney’s Office assists crime victims in numerous areas, including support during court hearings/trials, updating victims on case status and assisting victims in getting restitution. If you are a crime victim, please review the paragraphs below to allow us to better serve your needs.

Every victim of any crime, has the right to:
  • To be present during the entire trial unless you are to be called as a witness.
  • To be provided with a waiting area separate from the Defendant, his/her relatives and his/her witnesses.
  • To consult with the Prosecuting Attorney in order to give your views on the disposition of the crime.
  • To receive notice of any scheduled court proceeding and any change to that schedule.
  • To confer with the Prosecuting Attorney prior to a trial.
  • To receive notice if the Defendant escapes custody while awaiting trial.
  • To receive written notice of Defendant’s conviction.
  • To make an oral or written impact statement to the Judge at the time of sentencing.
Victim Advocacy

The Crime Victim Advocates act as a liaison between crime victims and witnesses, and the criminal justice system. Victim Advocates provide comprehensive services to assist victims through the criminal justice system. Services include court accompaniment, court notification, preparing victims for testimony, crisis intervention, providing emotional support, answering questions and keeping victims informed, ensuring victims understand the criminal justice system and their rights under the Crime Victim Rights Act. They also connect victims to community resources and referrals. Advocates assist victims with filing Crime Victim Compensation claims and Michigan Crime Victim Notification registration. 
Upon request, services provided by victim advocates include:
  • Status information on your case
  • Referrals for counseling, support groups, and other resources
  • Emergency services (food, shelter, and clothing)
  • Crime victim compensation information and assistance
  • Victim impact statement assistance 
  • Restitution information and assistance
  • Help with return of personal property
  • Accompanying a victim to court
  • Employer intervention
  • Courtroom orientation and information on how the court works
  • Preparing for testimony
  • Privacy prior to appearing in court
  • Personal Protection Order (PPO) assistance
