Michigan Freedom of Information Act (FOIA)
The Michigan Freedom of Information Act (FOIA) is a state law that provides the public with the right to access certain public records maintained by Michigan state and local government entities, including counties, cities, townships, and public authorities. The purpose of FOIA is to promote transparency, accountability, and informed participation in government.
Under FOIA, any person—except individuals who are incarcerated in a state or local correctional facility—may submit a written request to inspect, copy, or receive records maintained by a public body. Public records include documents, emails, reports, contracts, and other recorded information prepared, owned, used, possessed, or retained by the county in the performance of an official function.

The Michigan Freedom of Information Act requires Menominee County to respond to your request within five (5) business days days after your request is received. The day your request is recieved does not count towards the five (5) business days. Requests submitted on a weekend or recognized holiday will be considered to be received on the next business day.
Menominee County's initial response may include issuing a notice extending, for not more than ten (10) business days the period to respond to your request.
Fees and Exemptions
The Michigan FOIA allows public bodies to charge fees to cover the cost of processing a request, including labor, copying, mailing, and the cost of digital media. Fee estimates may be provided before records are released, and in some cases, a good-faith deposit may be required.
Menominee County may require a good-faith deposit of 50% of the estimated cost to produce the public records you requested if the total estimated cost exceeds $50.
Menominee County requires payment in full for actual costs to produce the public records you requested beforfe the public records will be released to you.
You have the right to appeal any fee assed to process your request to Chair of the Menominee County Board of Commissioners or seek judicial review in the Menominee County Circuit Court.
