INSTRUCTIONS FOR FILING A MOTION IN MENOMINEE COUNTY

Please complete this form by printing clearly with black ink or by typing.

  • Complete the first section of the form up to the “NOTICE OF HEARING”.

  • You must state your reason for the hearing clearly. Only complete the portions of the form which pertain to your circumstances.



  • Sign and date the form.

  • Either mail the form or personally bring the form to the Menominee County Friend of the Court Office at 839 10th Avenue, Menominee, MI 49858, along with the filing/judgment fee listed below.

    If you have a questions regarding the filing fee or the form, please contact our office at (906)863-8981. Checks should be made payable to: Menominee County Clerk of Court. If you opt to pay by cash, you may do so at the Friend of the Court Office, at which time you will receive a receipt for your payment.



    Effective October 1, 2004 the State of Michigan initiated a Judgment & Order entry fee. The fees apply to the filing of divorce judgments and post-judgment orders concerning modifying custody, support or parenting time. Listed below are the total fees for each type of motion:

    Fee for filing a Motion for Parenting Time, Custody, or Change of Domicile:

    $100.00 ($20 filing fee and $80 judgment fee)

    Fee for filing a Motion which addresses Custody, Parenting Time & Support in one form:

    $100.00 ($20 filing fee and $80 judgment fee)

    Fee for filing a Motion for Support: $ 60.00 ($20 filing fee and $40 judgment fee)

  • Once the completed form and fees are returned to the Friend of the Court Office, they will complete the form by obtaining a court date.

  • The Friend of the Court will file the original form with the Clerk of Court Office with the filing fee, mail a copy to the Plaintiff and Defendant and keep a copy for the Friend of the Court file. You must then both appear before the court on the assigned court date.

  • In some cases, the Judge assigned to your case requires the Friend of the Court meet with the parties prior to the hearing. If this is necessary, a letter will be sent to you and the other party advising the date and time which you are to meet with the Friend of the Court. This appointment will be scheduled several weeks prior to the scheduled hearing date. If an appointment is scheduled for your case with the Friend of the Court as required by the Judge and you do not attend, the hearing may be cancelled and your filing fee is forfeited.



    Motions are not accepted through FAX or E-Mail.

    Waiver of Filing Fee Form



  • Complete your information on the front side of the form. Do Not Sign the form prior to submitting it to the Friend of the Court as it requires Notarization, which the Friend of the Court provides free of charge.

  • Complete your motion form.



  • Turn both forms into the Friend of the Court Office.



  • The Friend of the Court will submit the Waiver Form to the Judge for a signature.



  • If the Judge signs the Waiver Form, the Friend of the Court will then schedule a hearing on your Motion. If the Judge does not sign the waiver form, the Friend of the Court will notify you that you will need to pay the filing fee prior to scheduling a hearing before the court.
