MINERAL RIGHTS INFORMATION

The Register of Deeds Office understands that there are questions regarding mineral rights on property in Menominee County, Michigan. County Policy prohibits us from giving anyone legal advice. We would like to provide you with what information we have.


Mineral Rights Searches
:

Mineral rights can be searched in the following ways:

1) Contact a title company to do it for you;

OR

2) Do the search yourself at the Register of Deeds Office at the Courthouse. You will need to bring the legal description(s) of the property you wish to search and the staff in the Register of Deeds office will provide you with the tract index book(s) that pertain to your legal description(s). You will search the index for documents that may contain a claim of interest or reservation for minerals, ores, etc. Then you will look for the appropriate documents, read them and make your own determination. The Register of Deeds Office is prohibited from performing title searches, interpreting or rendering opinions on the content of recorded documents.


Claiming an Interest:

A Notice of Interest form (available at the local title companies-see list below) must be completed according to State of Michigan recording requirements, properly signed, notarized and presented to the Register of Deeds office for recording. You can draft your own document or have a professional do it for you. The recording fee is $30.00. If the document does not meet the State of Michigan recording requirements, it cannot be recorded.

The Register of Deeds staff cannot draft nor instruct anyone on how to draft a document.
